By downloading, installing, or using Don't Miss Birthdays ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
Don't Miss Birthdays is a birthday and anniversary tracking application that helps users remember important dates. The App allows you to create profiles with birth dates and marriage dates, receive notifications for upcoming events, compare ages, browse wishes, and view statistics. Data is stored locally on your device and optionally synced via iCloud.
3. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on any Apple device you own or control, subject to these Terms and Apple's App Store Terms of Service.
4. User Responsibilities
When using Don't Miss Birthdays, you agree to:
- Use the App only for lawful purposes
- Not attempt to reverse engineer, decompile, or disassemble the App
- Not use the App in any way that could damage, disable, or impair the service
- Ensure you have the right to store personal information (names, dates) of the people whose profiles you create
- Respect the privacy of others when using the App
5. User Content
You retain ownership of any profiles and data you create within the App. You are responsible for the accuracy and legality of the information you enter. By using iCloud sync, you agree to Apple's iCloud Terms and Conditions for the storage and synchronization of your data.
6. Advertising
The App displays advertisements provided by Google AdMob. By using the App, you acknowledge that ads will be displayed. Ad personalization is controlled by your App Tracking Transparency choice. We are not responsible for the content of third-party advertisements.
7. Intellectual Property
The App, including its design, features, wishes content, and code, is owned by Don't Miss Birthdays and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App.
8. Third-Party Services
The App integrates with third-party services including:
- iCloud: Subject to Apple iCloud Terms and Conditions
- Google AdMob: Subject to Google's Terms of Service and Privacy Policy
- App Store: Subject to Apple Media Services Terms and Conditions
We are not responsible for the availability, accuracy, or content of these third-party services.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The App will meet your requirements
- The App will be uninterrupted, timely, secure, or error-free
- Notifications will always be delivered on time (notification delivery depends on iOS)
- Any errors in the App will be corrected
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DON'T MISS BIRTHDAYS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use or inability to use the App
- Missed notifications or reminders
- Unauthorized access to or alteration of your data
- Any third-party conduct or content, including advertisements
11. Indemnification
You agree to indemnify and hold harmless Don't Miss Birthdays from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App or violation of these Terms.
12. Termination
We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the App.
You may terminate your use at any time by deleting the App from your device.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes by:
- Updating the "Last updated" date
- Posting notice in the App or App Store update notes
Your continued use of the App after changes constitutes acceptance of the modified Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
